Terms of Service

Welcome to Figure Design (“Company,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your (“Client,” “you”) purchase and use of our web design services. By placing an order with us, you agree to these Terms.
1. Services Offered
We provide productized web design services exclusively built on the Framer platform.
Services are offered as fixed, one-time packages or as a custom quote option.
We do not provide traditional, itemized proposals or contracts for individual clients; all offerings are productized.
2. Payments
All payments are processed securely through Stripe.
Services are billed as a flat, one-time fee unless otherwise specified.
Our Maintenance Plans are subscription-based and billed every 30 days automatically until canceled.
3. Refund Policy
No refunds are offered once work has begun.
A refund may only be issued if:
We are unable to complete the service for reasons within our control, or
A refund is requested before any work has started.
Once work has started, all payments are final and non-refundable.
4. Revisions
All design services include unlimited revisions until the website is delivered and approved.
Revisions are limited to the scope of the purchased service (e.g., building within Framer, design adjustments, and content updates provided by the client).
Significant changes outside the original scope may require an upgrade or additional service purchase.
5. Communication
All communication will be handled via email only.
We do not conduct client calls, video conferences, or in-person meetings.
6. Client Responsibilities
Client must provide all necessary content, branding, images, copy, and other materials required to complete the project.
Delay in providing materials may extend project timelines.
Client is responsible for proofreading and approving all content provided for their website.
7. Deliverables & Ownership
Upon final payment and delivery, the completed website design becomes the property of the Client.
We reserve the right to include the website we create in our portfolio and marketing materials, unless Client requests otherwise in writing.
8. Maintenance Plan
The Monthly Maintenance Plan covers ongoing support, updates, and minor adjustments as outlined in the plan details.
It does not include full redesigns or services outside the original scope.
Client may cancel maintenance subscriptions anytime; cancellations take effect at the end of the current billing cycle.
9. Disclaimer of Warranties
We are not responsible for third-party platform issues (e.g., Framer outages, external integrations, third-party plugins).
We do not guarantee specific business results, sales performance, or SEO rankings.
10. Limitation of Liability
Our liability for any claim related to the services is limited to the amount paid by the Client for those services.
In no event shall we be liable for indirect, incidental, or consequential damages, including but not limited to lost profits or business interruptions.
11. General Terms
By purchasing a service, you affirm that you are at least 18 years old and authorized to purchase on behalf of yourself or your business.
These Terms constitute the entire agreement between you and Figure Design.
We reserve the right to update or modify these Terms at any time. Continued use of our services constitutes acceptance of the revised Terms.

Refund & Cancellation Policy

At Figure Design, we value transparency and fairness. This Refund & Cancellation Policy outlines the conditions under which refunds may or may not be granted, as well as how cancellations are handled. By purchasing our services, you agree to the terms below.
1. Project-Based Web Design Services
No Refunds Once Work Has Begun
Once design or development work has started, payments are final and non-refundable.
Eligible Refunds
Refunds will be issued only in the following cases:A refund request is submitted before any work has begun on your project.
We are unable to complete the service for reasons within our control.
Non-Eligible Refunds
Refunds will not be issued for:Change of mind after work has started
Dissatisfaction with style preference (covered instead by our unlimited revisions policy)
Delays caused by the Client (e.g., failure to provide content or approvals in a timely manner)
2. Maintenance Plan Subscriptions
Automatic Billing
Maintenance Plans are billed every 30 days automatically via Polar until canceled.
Cancellation by Client
Clients may cancel their Maintenance Plan at any time by notifying us via email.
Cancellation will take effect at the end of the current billing cycle, meaning no partial or prorated refunds are provided.
Refunds for Maintenance Plans
Payments for Maintenance Plans are non-refundable once the billing cycle has started.
If canceled mid-cycle, service will continue until the billing period expires, but no refund will be issued.
3. Process for Refunds & Cancellations
All requests must be made in writing via email to hello@figure.design.
If eligible, refunds will be processed within 10 business days back to the original payment method.
For cancellations of Maintenance Plans, confirmation will be sent once your subscription has been successfully terminated.
4. Exceptions
We reserve the right to make exceptions in rare or extraordinary cases at our discretion. However, our general stance is strictly no refunds once work has begun, and no prorated refunds on subscriptions.

Payment Information is collected and processed securely through Stripe. We do not store or have direct access to your full payment details.
Content & Materials you provide for your project (logos, text, images, etc.), which are used solely for delivering your website.
Technical Information (such as browser type, device, and usage data) which may be automatically collected through our website for analytics and performance purposes.
2. How We Use Your Information
We use the information we collect to:
Provide, deliver, and maintain our web design services.
Process payments securely through Stripe.
Communicate with you via email regarding projects, support, or billing.
Improve our services and website performance.
Maintain internal business records and comply with legal obligations.
3. Sharing of Information
We do not sell, rent, or trade your personal information. Your information may be shared only in the following cases:
Service Providers: With trusted third-party tools (e.g., Stripe for payment processing) to complete transactions.
Legal Compliance: If required by law, regulation, or government request.
Business Operations: In rare circumstances, such as a business transfer or restructuring.
4. Data Security
We take reasonable administrative and technical measures to protect your information from unauthorized access, disclosure, or misuse.
All payment transactions are securely processed through Stripe and are not stored on our servers.
5. Data Retention
We retain client records and project files only as long as necessary to fulfill the purpose for which they were collected.
You may request deletion of your personal information by contacting us directly, subject to our legal and administrative requirements.
6. Your Rights
Depending on your location, you may have certain rights under applicable privacy laws, including:
Access to the personal data we hold about you
Requesting corrections or updates to your data
Requesting deletion of your data (subject to obligations)
Opting out of marketing communications (though we primarily communicate for service purposes, not marketing)
7. Cookies & Tracking
Our website may use cookies or similar technologies for analytics, performance, and stability.
You may disable cookies in your browser, but some features of our site may not function properly if you do so.
